"One of the outstanding authorities on the early days of the Republic, Saul K. Padover offers in this volume a generous sampling of the letters, essays, speeches, discourses, and personal documents--many of them previously unpublished--of the men who made America. Included are extensive selections from the papers and speeches of John Adams, Benjamin Franklin, Alexander Hamilton, Thomas Jefferson, James Madison, and George Washington. There are also copious extracts from the private and public utterances of secondary, but important, figures (...) of the founding days--Samuel Adams, Elbridge Gerry, Patrick Henry, John Dickinson, Oliver Ellsworth, William Paterson, Benjamin Rush, George Wythe, and many others. A number of the speeches made at the Constitutional Convention in 1787 are given in full, and several of the important debates are reproduced. John Dickinson's Letters from an American Farmer in Pennsylvania appear in these pages as well as many of Alexander Hamilton's famous and brief opinions. Also included are John Hancock's speech on the Boston Massacre; Thomas Jefferson's Notes on Virginia; James Madison's Memorial against Religious Assessments; two of the most important of John Marshall's Supreme Court decisions (Marbury vs. Madison and McCulloch vs. Maryland); Robert Morris' Letters on Finance; John Taylor's paper On Aristocracy, and William Paterson's Plan for a Constitution. Taken together, these writings offer in one volume a complete picture of the thinking, the debate, the legal maneuvers, the compromises, the manners, and the morals of the American nation's earliest days. The book provides a sound basic appreciation of the atmosphere in which the Founding Fathers worked and planned and debated with one another. All the many counter-currents that contributed to the building of the Constitution, the stresses to which the young nation was subjected, the rebellion that continued to seethe, the moral climate of the days--these are all recreated in the speeches and writings of America's first patriots. When Benjamin Franklin suggested that man is by nature a tool-making animal, he summed up what was for his fellow Americans the common sense of the matter. It is not, then, surprising that, when Britain's colonists in North America broke with the mother country over the issue of an unrepresentative parliament's right to tax and govern the colonies, they defended their right to the property they owned on the ground that it was in a most thorough-going sense an extension (...) of themselves: the fruits of their own labor. This understanding they learned from John Locke, who based the argument of his Two Treatises of Government on the unorthodox account of providence and of man's place within the natural world that Sir Francis Bacon had been the first to articulate. All of this helps explain why the framers of the American constitution included within it a clause giving sanction to property in ideas of practical use. (shrink)

According to Quine’s indispensability argument, we ought to believe in just those mathematical entities that we quantify over in our best scientific theories. Quine’s criterion of ontological commitment is part of the standard indispensability argument. However, we suggest that a new indispensability argument can be run using Armstrong’s criterion of ontological commitment rather than Quine’s. According to Armstrong’s criterion, ‘to be is to be a truthmaker (or part of one)’. We supplement this criterion with our own brand of metaphysics, 'Aristotelian (...) realism', in order to identify the truthmakers of mathematics. We consider in particular as a case study the indispensability to physics of real analysis (the theory of the real numbers). We conclude that it is possible to run an indispensability argument without Quinean baggage. (shrink)

In Marshall's Tendencies (Sutton, 2000), John Sutton poses some fairly deep questions for economists, especially for empirical work. In particular, when (if ever) is it safe to behave as though the applies? In that paradigm, we are attempting to extract and estimate the model from the data and are only kept from doing so because, while economic analysis captures the main , there are many small influences that we cannot exactly take into account. That paradigm, which Sutton traces to an (...) analogy of Marshall's likening economic predictions to predictions of the tides, leads to the econometric estimation of economic relationships, taking statistical account of the unincluded small influences by placing them in a random disturbance term. Rather than being inherently evil, business lobbying is a socially responsible activity which needs to be restrained by ethical standards. To be effective in a business environment, traditional ethical standards need to be translated into language which business persons can speak comfortably. Economical explanations must also be available to explain why ethical standards are appropriate in business. Eight such standards and their validating arguments are proposed with examples showing their use. Internal dialogues regarding the ethics of lobbying objectives and tactics (...) will plausibly occur only in businesses which recognize social responsibility mandates. Public interest stakeholders could hasten this recognition by making use of information made available by the Lobbying Disclosure Act of 1995 to institute external dialogues regarding lobbying by specific businesses and industry groups. Given practical ethical standards and the information on business lobbying provided by the law, the press, corporate activists, consumers, pension fund managers and the public can apply pressure for ethical lobbying practices. Maher (1988, 1990) has recently argued that the way a hypothesis is generated can affect its confirmation by the available evidence, and that Bayesian confirmation theory can explain this. In particular, he argues that evidence known at the time a theory was proposed does not confirm the theory as much as it would had that evidence been discovered after the theory was proposed. We examine Maher's arguments for this "predictivist" position and conclude that they do not, in fact, support his (...) view. We also cast doubt on the assumptions of Maher's alleged Bayesian proofs. Aim: The aim of this paper is to present the development and evaluation of an art psychotherapy brief treatment method for complex depression for patients referred to mental health services.Background: Art Psychotherapy literature describes a range of processes of relational change through the use of arts focused and relationship focused interventions. Complex depression has a prevalence of 3% of the population in the West and it is recorded that in 2016 only 28% of that population were receiving psychological treatment. This (...) study was developed to test the hypothesis of whether an accessible and acceptable approach to the treatment of complex depression could be developed in relation to existing evidence-based practice within mental health services.Method: The United Kingdom Medical Research Council phased guidance for complex intervention development was used to develop the intervention. The process included producing a literature overview, systematic description of clinical practice, including a logic model and a clinical protocol. The art psychotherapy protocol described an arts-based dynamic interpersonal therapy approach, offered 1:1 over 24 sessions. Further to this the intervention was tested for referrer acceptability. The intervention is in the early stages of evaluation, using changes to the patient's depression and anxiety measured pre- and post-treatment with a follow-up measure at 3 months following completion of treatment.Results: Phase I of the study provided a good basis for developing a logic model and protocol. The authors found that there was good clinical consensus about the use of a structured clinical art psychotherapy method and the literature overview was used to support specific examples of good practice. The verification of clinical coherence was represented by a logic model and clinical protocol for delivering the intervention. The acceptability study demonstrated very high levels of acceptability for referrers reporting that ADIT was acceptable for patients with complex/major depression, that they were likely to refer to ADIT in the future that the use of arts was likely to improve accessibility the use of arts was likely to improve outcomes and that offering ADIT was an effective use of mental health resources.Discussion: Phase I of this intervention development study demonstrated theoretical and practice coherence resulting in a clinical protocol and logic model. Whilst Phase II of this study showed promising results, Phase II would need to be sufficiently scaled up to a full trial to further test the intervention and protocol. (shrink)

Using the history of political thought and real-world political contexts, including South Africa and the recent global financial crisis, this book argues that power is integral to freedom. It demonstrates how freedom depends upon power, and contends that liberty for all citizens is best maintained if conceived as power through political representation. Against those who de-politicise freedom through a romantic conception of 'the people' and faith in supposedly independent judicial and political institutions, Lawrence Hamilton argues that real modern freedom (...) can only be achieved through representative and participative mechanisms that limit domination and empower classes and groups who become disempowered in the conflicts that inevitably pervade politics. This is a sophisticated contribution to contemporary political theory that will be of interest to scholars and students of history, politics, philosophy, economics, sociology, development studies and Southern African studies. In a recent article in this Journal, Shlomo Cohen and Haim Shapiro introduce the concept of “comparable placebo treatments” —placebo treatments with biological effects similar to the drugs they replace—and argue that doctors are not being deceptive when they prescribe or administer CPTs without revealing that they are placebos. We critique two of Cohen and Shapiro’s primary arguments. First, Cohen and Shapiro argue that offering undisclosed placebos is not lying to the patient, but rather is making a self-fulfilling prophecy—telling a (...) “lie” that, ideally, will become true. We argue that offering undisclosed placebos is not a “lie” but is a straightforward case of deceptively misleading the patient. Second, Cohen and Shapiro argue that offering undisclosed CPTs is not equivocation. We argue that it typically is equivocation or deception of another sort. If justifiable, undisclosed placebo use will have to be justified as a practice that is deceptive in most instances. (shrink)

Christian morality has been of enormous significance in world history and still underpins moral notions today. In this groundbreaking volume, J. Ian H. "Many theologians, as well as many philosophers, may be heard today asserting that there neither is nor can be any such thing as a uniquely Christian ethical system. On the one hand it is argued that an ethic based on revelation must be inherently static, unable to respond to new demands and situations; but if the ethical code is little more than a refinement of so-called natural law or natural morality, then there is no reason to term it Christian. In (...) consequence, most of the current discussion in the field of ethics addresses itself almost exclusively to a consideration of such specific issues as war, sex, abortion or mercy killing. Professor N. H. G. Robinson, however, turns his attention to the basic question of what Christian ethics really is. Morality, Robinson argues, was not created by Christianity, but exists independently; all men are subject to it, whatever their belief. This fundamental truth about human beings is of profound significance for theology, which must continue to insist upon an objective moral code. We will never understand Christian ethics, Robinson asserts, until we accept the doctrine of natural morality. But there can hardly be two moralities—one natural and the other supernatural—each competing for our obedience. Rejecting both the medieval and the post-Reformation approaches to the relationship of natural and Christian ethics, Robinson looks to the redemptive nature of Christian revelation for his answer. Moral standards are not merely imposed upon us, nor do we invent them; we discover them—their authority depends on their existing independently of us. It is the entry of redemptive revelation into the system of moral philosophy that creates what Robinson describes as "natural morality, judged, reoriented and transformed, and brought under the forgiving and reconciling lordship of Christ, which constitutes the Christian life." Here, then, is no inflexible, static code, incapable of responding to change. Rather, Robinson, describes a creative ethic that is objective, normative, and theocentric, a morality always in the making; it is a way of life, not a closed system. "Moral rules," he overserves, "are yesterday's moral solutions." This book focuses on the political thought of American statesmen. These statesmen have had consistent and comprehensive views of the good of the country and their actions have been informed by those views. The editors argue that political life in America has been punctuated by three great crises in its history-the crisis of the Founding, the crisis of the House Divided, and the crisis of the Great Depression. The Second World War was a crisis not just for America but for (...) the whole of Western Civiliation and, in the wake of that war, a new crisis arose which came to be called the "Cold War." Just when that gave the appearance of being resolved, the world reached a new juncture, a new crisis, which Samuel P. Huntington dubbed the "clash of civiliations." The statesmen having political responsibility in confronting the first three crises in America's history came as close to philosophic grasp of the problems of liberal democracy as one could demand from those embroiled in the active resolution of events. Their reflection of political philosophy in the full sense informed their actions. Since we cannot confidently explain the future, Aristotle warned us to call no man happy while he still lives. Thus the book, in its third edition, keeps to its settled pattern of dealing with settled matters. The preface to the third edition confronts the three later crises and, to the extent consistent with truth, attempts to relate them to the first three. Morton J. Frisch was professor emeritus of political science at Northern Illinois University. He was the author or editor of several books, including Selected Writings and Speeches of Alexander Hamilton; Alexander Hamilton and the Political Order; and Franklin D. Roosevelt: The Contribution of the New Deal to American Political Thought and Practice. Richard G. Stevens retired from National Defense University as professor of political science in 1994. Since then he has taught as an adjunct professor of government at American University. He is co-editor with Matthew J. Franck of Sober as a Judge: The Supreme Court and Republican Liberty, and the author of The American Constitution and Its Provenance; Reason and History in Judicial Judgment: Felix Frankfurter and Due Process; and Political Philosophy: An Introduction. Given the long-standing controversy about whether the brain-dead should be considered alive in an irreversible coma or dead despite displaying apparent signs of life, the ethical and policy issues posed when family members insist on continued treatment are not as simple as commentators have claimed. In this article, we consider the kind of policy that should be adopted to manage a family's insistence that their brain-dead loved one continues to receive supportive care. We argue that while it would be ethically (...) inappropriate to continue to devote scarce acute care resources to such patients in a hospital setting, it may not be ethically inappropriate for patients to receive these resources in certain other settings. Thus, if a family insists on continuing to care for their brain-dead loved at their home, we should not, from a policy perspective, interfere with the family's wishes. We also argue that healthcare professionals should make some effort to facilitate the transfer of brain-dead patients to these other settings when families insist on continued treatment despite being informed about the lack of any potential for recovery of consciousness. Our arguments are strengthened by the fact that patients in a persistent vegetative state, who, when correctly diagnosed, also have no potential for recovery of consciousness, are routinely transferred from hospitals to nursing homes or long-term care facilities where they continue to be ventilated, tube fed and to receive other supportive care. We also briefly explore the question of who should be responsible for the costs of such treatment at the long-term care facility. (shrink)

This article investigates how mid-thirteenth-century theologians grappled with questions of angelic embodiment and corporeal life-functioning. Regent masters such as Alexander of Hales, Richard Fishacre, Richard Rufus of Cornwall, Albertus Magnus, Thomas Aquinas, and Bonaventure variously employed scriptural and patristic sources in conjunction with Aristotelian philosophy to develop a basic metaphysics of angels according to which these inherently incorporeal spiritual creatures assume bodies not on account of any necessity on their part, but rather simply so that we humans might understand their (...) divinely-ordained ministries. Because the relationship between angels and their bodies is strictly occasional and extrinsic, aiming at human instruction, embodied life-functions that are natural to humans are not natural to angels. Rather, angels merely act in anthropomorphic ways in order to fittingly reveal the divine will to human comprehension. (shrink)

Aim: This aim of this study is to describe the development of a program logic model to guide arts-based psychosocial practice delivered in rural South African farming communities affected by transgenerational traumas.Background: The rationale for developing a program logic model for arts-based psychosocial practice in South Africa was based on the lack of evidence for effective community arts-based psychosocial interventions for collective trauma, unknown consensus about best practices and the need for developing cogent collective psychosocial practices. Further to this, the (...) aims and benefits of the practice required clarity given the psychosocial complexity of the environment within which the practices for this population are being offered. The logic model offers a valuable resource for practitioners, participants and funders to understand the problem being addressed, how practice is defined, as well as the impact of practice and on intermediate and longer term goals.Methods: The authors used a systematic iterative approach to describe the operationalization of arts-based psychosocial practice. This resulted in the design of the logic model being informed by data from focus groups, an overview of the literature regarding transgerenational trauma in this population, operational policies and organizational documents. The development of the logic model involved actively investigating with practitioners their work with remote farming communities. We thematised practitioners practice constructs to identify salient practice elements and their relationship to perceived benefits and lastly feedback from practitioners and participants following implementation to make adjustments to the logic model.Results: The results were clearly identified in the form of visual mapping using the design of a program logic model. The logic model was divided into 5 parts and was verified by practitioners following implementation. The parts of the program logic model are main presenting problem, operational processes, practice elements, benefits, and impact and review. (shrink)

Opinions about cognitive enhancement (CE) are context-dependent. Prior research has demonstrated that factors like peer pressure, the influence of authority figures, competition, moral relevance, familiarity with enhancement devices, expertise, and the domain of CE to be enhanced can influence opinions. The variability and malleability of patient, expert, and public attitudes toward CE is important to describe and predict because these attitudes can influence at-home, clinical, research, and regulatory decisions. If individual preferences vary, they could influence opinions about practices and regulations (...) due to disagreements about the desirable levels of risks and benefits. The study of attitudes about CE would benefit from psychological theories that explain judgments. In particular, we suggest that variability in risk and benefit sensitivity could psychologically mediate judgments about CE in many contexts. Drawing from prospect theory, which originated in behavioral economics, it is likely that framing effects, shifted reference points, and the tendency to weigh losses (risks) more heavily than gains (benefits) predict decisions about CE. We suggest that public policy could benefit from a shared conceptual framework, such as prospect theory, that allows us to describe and predict real-world decisions about CE by patients, experts, and the public. Plochmann and Robinson closely analyze this great dialogue in the first two-thirds of their book, turning in the final four chapters to a broader discussion of its unity, sweep, and philosophic implications.

Controversies about the diagnosis and meaning of brain death have existed as long as the concept itself. Here we review the historical development of brain death, and then evaluate the various attempts to justify the claim that patients who are diagnosed as brain dead can be considered dead for all legal and social purposes, and especially with regard to procuring their vital organs for transplantation. While we agree with most commentators that death should be defined as the loss of integration (...) of the functioning of the organism as a whole, we conclude that patients diagnosed as brain dead have not, in fact, lost this integrated functioning. We close with reflections on the implications of this conclusion generally and particularly with regard to organ transplantation, and briefly make reference to alternative approaches to justifying the procurement of transplantable organs that do not depend upon a flawed approach to the diagnosis of death. In the early twenty-first century, philosophy stemming from the continental tradition has become overtly realist. This does not mean it abandons the sophisticated structures of reflection for a givenness on the refutation of which its earliest moments, in Kant, was premised. Nor does it entail a rediscovered faith in the adequacy of intellect to thing. Rather, we might say, new realisms have issued from a critique of transcendental dogmas. In this paper I will provisionally characterise the most salient of these (...) transcendental dogmas before characterizing some of the experiments in removing them. (shrink)

Current struggles over laws prohibiting and criminalizing the public disclosure of violence in the spaces of animal use in the US have underscored the centrality of exposés to animal activism. This article complicates the activist belief in the power of exposure—“If slaughterhouses had glass walls...”—by drawing on the insights of Jean-Paul Sartre and Simone de Beauvoir concerning the prevalence of bad faith in systems of oppression and exploitation. I describe four forms of bad faith common to these systems, and offer (...) suggestions for exposés of the animal enterprise modeled on Sartre’s and de Beauvoir’s “engaged exposés.”. (shrink)
